Payment Terms and Conditions
2025 Pro Grower/Evolution Ag Winter Getaway

These Terms & Conditions (“Terms”) form a contract between Pro Grower Solutions and the travelers identified within the registration form (the “Travelers”) governing Travelers’ registration to attend the 2025 Pro Grower/Evolution Ag Winter Getaway in Cap Cana, Dominican Republic(“Trip”). Please read these Terms carefully.

Reservations Requirement:
All Travelers must register online, complete the Liability Waiver and submit Trip Deposit payment online to Summit Planners before they can confirm reservations for the Trip. Such payment is the Travelers’ confirmation that the Travelers agree to these Terms. Resources to register and complete the Liability Waiver can be found by clicking here.

Payment Form – 2025 Pro Grower Evolution Ag

Summit Planners has setup a separate secure payment site (“Payment Form” to facilitate Trip Deposit Payments ($700/registration) and Group Catamaran Payments ($60 per person). The Trip Deposit Payment is required for Travelers who have registered for a group block room at the Hyatt Zilara Cap Cana for the Trip. Trip Deposit Payments must be submitted on the Payment Form by November 1st, 2024, and all deposit funds go toward the Traveler’s Trip Package Costs. The Group Catamaran is an optional activity for travelers on the trip. Group Catamaran Payments must be submitted on the Payment Form by November 1st, 2024.

  • Payment Form’s Payment Process: Payments will be approved and the associated reservation(s) confirmed after payment is successfully submitted on the Payment Form. A confirmation message will display after a successful payment and a receipt will be sent to the email address provided on the Payment Form. Funds will be exchanged 3 business days after payment was submitted.
  • Refunds for Purchases made on Payment Form: After funds have been exchanged, any refunds required within 180 days of the initial payment will be applied back to the original card used. Refunds required after that timeframe will be by sent by check.

Remaining Payment Due:
Remaining payments will be handled directly with Pro Grower/Evolution Ag.  Contact Donna or Terry at Pro Grower Solutions/Evolution Ag (1-877-646-2855 ) with any questions.

Trip Package
The cost of the Trip is a package price with the inclusions identified below. Other than the “Optional Activity – Private Group Catamaran”, Pro Grower Solutions/Evolution Ag is not responsible for refunding travelers for any ancillary expenses incurred by the travelers, which are not included within the package price of the Trip.

Pro Grower Solutions and Evolution Ag are providing the following inclusions for 2025 Winter Getaway qualifiers and a guest of their choice (two travelers*):

  • 5-night Junior Suite Ocean View accommodations at the Hyatt Zilara Cap Cana
  • The Group Nights consist of 5-nights (2/4/2025 to 2/9/2025)
  • All-inclusive breakfast, lunch, dinner, snacks, mini-bar, and alcoholic beverages
  • All taxes, service charges and bellman/maid gratuities
  • Round trip group airfare from: Des Moines or Cedar Rapids** | Departing 2/4/25 & Returning 2/9/25
  • Round trip airport transfer and gratuity in Punta Cana
  • Pro Grower Solutions/Evolution Ag private events
  • Personalized travel services from Summit Planners Inc.
    *All guests must be over 18 years old
    ** Seats out of each city are based on limited availability and will be filled on a first-come, first-serve basis. You may request extra nights post-trip dates in Punta Cana, upgraded seats, specific airlines or another departure city; however, additional fees may apply depending on what you choose. Name changes can be made to issued group tickets up to 48 hours prior to departure for $35.00 per ticket. Additional fees as a result of individual deviations from group arrangements will be charged to the individual. See “Extra Nights/Deviation Terms” for more details. Trip Package – Cancellation Terms
Cancellations must be emailed to ProGrowEvoAg@spmeetings.com and received by 5:00 pm EST on the last day of the applicable cancellation time period. Other than the “Optional Activity – Private Group Catamaran”, Pro Grower Solutions/Evolution Ag is not responsible for refunding Travelers for any ancillary expenses incurred by the Travelers, which are not included within the package price of the Trip. Cancellation after Monday, July 29, 2024 may be subject to cancellation charges listed below:

  • Cancellations prior to October 28, 2024: $4,130 Double Occupancy | $3,644 Single Occupancy
  • Cancellations from October 29 to December 10, 2024: $4,429 Double Occupancy | $3,812 Single Occupancy
  • Cancellations from December 11 to December 30, 2024*: $6,311 Double Occupancy | $4,724 Single Occupancy
  • Cancellations from December 31 to February 4, 2025*: $6,465 Double Occupancy | $4,802 Single Occupancy

*If airline tickets have been issued, each traveler will retain a credit with the airline for the value of the ticket good for one year after the date the ticket was issued.
Trip Deposits received prior to cancellation will be deducted from the cancellation charges in the table above.
There will be no refunds for travelers that attend the trip but require an unexpected early departure


Private Group Catamaran (Optional Activity)

Travelers have the opportunity to sign-up for a private group catamaran sponsored by Pro Grower and Evolution Ag. For $60 per person, the activity includes private round-trip group transfers, a private group sail and snorkel for over 3.5 hours with an open bar and snacks while onboard. The activity is currently scheduled to depart the hotel on 2/7/2025 at 12:45 PM and return to the resort by 5:45 PM. See additional details by following this link. Travelers can register for the Catamaran using the trip’s online Payment Form to secure their reservation.  Group Catamaran payments are due by November 1st, 2024. If fewer than 50 members of the group confirm a catamaran reservation by 1/1/2025, this group activity is subject to cancel and refunds will be sent according to the cancellation policy below.
Private Group Catamaran (Optional Activity) – Cancellation Terms
Cancellation after dates listed below may be subject to cancellation charges as follows:

  • Cancellations before January 27th, 2025: $0 per person (full refund)
  • Cancellations between January 27, 2025 and February 7, 2025: $60 per person (no refund)

Cancellation Terms for Deviations booked through Summit Planners:
The cancellation and change terms listed below apply only to the deviation portion of your trip and are in addition to any cancellation terms applicable to the group nights. If you booked a deviation with Summit Planners the terms to cancel your deviation are included in the deviation proposal emailed to you before you provided payment for the deviation. A deviation would be any additional accommodation you requested to be included outside of what is included in the trip package (for example extra nights).

You may request extra nights, upgraded room accommodations or non-group flight arrangements while registering. Travelers must submit payment for the $700 Trip Deposit on the Trip’s Payment Form before Summit Planners can begin working on arrangements for requested deviations. Summit Planners will follow-up via email with options and costs based on your requests. To confirm an option, online payment will be required. Summit Planners will email you an invoice for payment which will confirm your updated reservation. Deviation invoices will arrive in the travelers inbox from Summit Planners Inc <invoice@authorize.net>.

If you need to make changes or cancel a deviation, please contact Summit Planners via email ProGrowEvoAg@spmeetings.com or by calling 574-968-4301. If you cannot make the trip for whatever reason, you will be responsible for confirmed deviation fees. Summit will work with suppliers to obtain refunds where possible.
Hotel Reservations: The cost of extra nights or upgraded rooms for your stay are non-refundable from the time of payment.
Ground Transfers: The cost for deviated ground transfers in the destination are non-refundable within 72 hours of the trip’s departure date.
Airline Reservations: For flight accommodations, an air credit from the trip is applied before charges are assessed. If you cancel subsequent to confirming travel accommodations in writing, you may be charged the fees below.

According to airline policy, issued airline tickets are non-refundable and any changes or cancellations will incur a fee/and or additional airline charges plus any fare difference. In some cases, changes to the itinerary or passenger name invalidate the airline ticket and require you to purchase another replacement ticket. No shows will result in forfeit of ticket value. Your “Ticket Type” will be indicated when you receive options from Summit Planners via email. Below are ticketing deadlines for your Ticket Type. Flight schedules are subject to schedule changes from the airline. Summit Planners will send you a final itinerary 30 days prior to departure day.

  • Ticket Type – Individual Airfare: Your tickets will be issued once payment is provided. Tickets may be voided within 24 hours of being issued without fee and can only be issued with full payment. You must contact us, during normal business hours*, within 24 hours of providing payment with any necessary corrections to avoid fees/charges.
  • Ticket Type – Group Airfare: Tickets may be voided up to 90 days prior to the originating departure flight without fee. From 89 days to 50 days prior to the originating departure flight, flights can be cancelled for a $120.00 per ticket fee. Beginning at 49 days prior to the originating departure flight, tickets are non-refundable. However, name changes can be made for a fee of $30.00 per ticket up to 72 hours prior to departure.


Entry/Participation Requirements:
Pro Grower Solutions advises the Travelers to check the Dominican Republic entry requirements posted by the U.S. Department of State. It is the responsibility of the Travelers to ensure they each meet all entry requirements. A valid passport is required for international travel. Passports must have 6 months’ validity on them from the return date of the Trip. The Travelers understand it is their responsibility to arrive in time for travel departure. Pro Grower Solutions assumes no responsibility, liability, or expense for the Travelers’ inability to travel or participate in any activity or event hosted by Pro Grower Solutions due to insufficient, inaccurate, or expired travel, medical, and identifying documentation by the Travelers, or failure to arrive on time for travel departures or participation in events or activities for any reason, including those reasons that are out of the control of the Travelers.

Compliance with Laws:

The Travelers agree to abide by all applicable domestic and international laws and regulations in the countries of travel and residency

Acknowledgement of Risk, Assumption of Risk, and Release of Liability:

The Travelers understand and acknowledge that the Trip has some inherent risks, dangers, and hazards, including (i) risks of travel interruption, delays, crashes, and/or airborne or foodborne illnesses; (ii) luggage being lost, misdirected, or stolen during travel; (iii) inherent risk of injury, illness, death, and/or other bodily harm; (iv) risks related to bus transportation and other trip-related services performed by certain third party suppliers; (v) damaged, lost, or stolen property; and (vi) hospital facilities, qualified medical care, and emergency medical evacuation being limited or unavailable during the Trip and, where available, may be expensive. This list of risks is not an exclusive or exhaustive list of all the risks and hazards associated with the Trip. By participating in the Trip the Travelers voluntarily and irrevocably accept and assume all risks, dangers, and hazards, such as the risks identified above, whether known or unknown, whether foreseeable or unforeseeable, and all responsibility for any and all losses and/or damages, whether caused in whole or in part by the negligence or other conduct of Pro Grower Solutions or its employees, agents, or contractors/third-party suppliers (collectively, the “Trip Releasees”). The Travelers agree to release and absolve the Trip Releasees from any and all liability for personal injury and property damage during the Trip. The Travelers understand that this release means that Travelers, along with their family, guardians, estate, heirs, executors, administrators, assigns, and personal representatives, give up their right to bring any claims, lawsuits, or causes of action, including claims for personal injuries, death, disease, or property losses, or any other loss, and also including, but not limited to, claims of negligence and breach of contract.

Indemnification:

The Travelers, along with their family, guardians, estate, heirs, executors, administrators, assigns, and personal representatives, agree to indemnify, defend, and hold harmless the Trip Releasees from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including but not limited to attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Trip Releasees due to injury, illness, death, other bodily harm, loss of use, monetary loss, or any other injury from or relating to my participation in the Trip, whether or not caused by the negligence or other conduct of any Trip Releasees.

Loss, Theft, or Damage:
Without limitation of any other provision of this Agreement, the Travelers understand and agree that the Trip Releasees will not be liable for any loss or theft of or theft or damage to the Travelers’ respective property, regardless of the cause.

No Reimbursements:
The Travelers understand that all required credentials, visas, permits, insurance, and other travel, medical, and identifying documentation are the sole responsibility and at the sole expense of the Travelers.

Events Beyond Pro Grower Solutions’ Control:

Except where otherwise expressly stated in these Terms, Pro Grower Solutions will not be liable or pay the Travelers compensation if Pro Grower Solutions obligations under these Terms are affected by Events Beyond Pro Grower Solutions’ Control, including cancellation of the Trip. “Events Beyond Pro Grower Solutions’ Control” means any event beyond Pro Grower Solutions’, its agents’, or its contractors’/third-party suppliers’ control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as, epidemics, pandemics (including the ongoing impact of the COVID-19 pandemic), the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labor strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events.

Governing Law:

These Terms shall be governed by the laws of the state of Indiana.
